  • What is a Complaint?

    A Complaint, or Adversary Complaint, is petition filed with the bankruptcy court in order bring a lawsuit against you or your creditor for any type of violation within the bankruptcy. The complaint will will the facts pertaining to the lawsuit and ask the bankruptcy courts to enter a judgment based on presented facts and the law. Whenever the complaint is filed, the court will issue a summons to be given to the person the complaint was filed against along with a copy of the complaint. After that the person will have a certain number of days to respond to the complaint by filing an answer with the court. If the person does not file an answer on or before the deadline, the bankruptcy will enter that the person is in default, failed to respond, and the the other party can file a default judgment.
